The exact services, descriptions, prices, duration, availability, and applicable terms may change from time to time.

3. Nature of Astrology Services

Astrology consultations are provided as guidance, interpretation, advisory and informational services based on astrological systems and the information supplied by the customer.

Astrological interpretations may differ between practitioners, methodologies, schools of thought, birth-time assumptions, software, calculations, and available information.

Accordingly:

• no particular result or outcome is guaranteed;

• predictions, interpretations, opinions and guidance are not guarantees of future events;

• astrology should not be treated as an exact or infallible science;

• customers should exercise their own independent judgment when making decisions; and

• Destiny Decoded does not represent that every prediction, interpretation, recommendation or observation will be accurate, complete, or applicable in every individual circumstance.

The customer remains solely responsible for decisions made after or in connection with a consultation.

4. No Guarantee of Results

Destiny Decoded does not guarantee any specific outcome relating to:

• marriage;

• relationships;

• compatibility;

• career;

• employment;

• education;

• business;

• finance;

• investments;

• property;

• family matters;

• personal circumstances;

• timing of events;

• health or wellbeing;

• legal matters;

• examinations;

• pregnancy;

• fertility;

• conception;

• or any other future event or circumstance.

Any statement regarding a possible future event should be understood as an astrological interpretation or opinion and not as a guarantee, promise, representation of certainty, or assurance of a particular outcome.

5. No Medical, Legal, Financial or Professional Advice

Astrology consultations are not a substitute for professional advice.

Nothing provided through the Website or during a consultation should be interpreted as:

6. Astrology, Vastu and Traditional Practices

Destiny Decoded may provide guidance relating to Vedic astrology, Vastu, Muhurt, horoscope interpretation, compatibility, traditional practices and related subjects.

Such services are provided as traditional, cultural, spiritual, advisory or interpretive services, as applicable.

Nothing on the Website authorizes or encourages:

• human sacrifice;

• physical harm;

• abuse;

• coercion;

• intimidation;

• sexual exploitation;

• dangerous or harmful rituals;

• fraudulent claims of supernatural powers;

• threats of death, injury, illness or misfortune;

• extortion;

• forced payments;

• deception for financial gain;

• or any other unlawful or prohibited activity.

Destiny Decoded will not knowingly provide or promote any service intended to facilitate unlawful, harmful, exploitative, fraudulent, or prohibited conduct.

The Maharashtra Prevention and Eradication of Human Sacrifice and other Inhuman, Evil and Aghori Practices and Black Magic Act, 2013 specifically contains savings relating to advice by astrologers and Vastu practitioners, while separately prohibiting specified inhuman, exploitative and black-magic practices. Destiny Decoded intends to operate strictly within applicable law.

7. Eligibility

The Services are intended primarily for individuals who are legally capable of entering into a binding contract under applicable Indian law.

If a person is below the applicable age of majority or is otherwise legally incapable of entering into a contract, the Services should be used only with the involvement and consent of a parent or lawful guardian.

Where information relating to a child is submitted, the parent or lawful guardian is responsible for ensuring that any required consent is validly provided.

Destiny Decoded reserves the right to refuse or cancel a booking where it reasonably believes that the booking has been made by a person who is not legally authorized to use the Services.

8. Booking of Consultations

Consultations may be booked through the Website or through third-party booking infrastructure used by Destiny Decoded.

The customer may be required to provide information including:

• name;

• email address;

• WhatsApp/mobile number;

• consultation/service type;

• appointment date and time;

• and other information reasonably necessary to arrange the consultation.

Customers are responsible for ensuring that all information supplied during booking is accurate and complete.

Incorrect birth date, birth time, birth place, contact information or other information supplied by the customer may affect the consultation or interpretation.

Destiny Decoded shall not be responsible for errors arising from inaccurate, incomplete, misleading or outdated information supplied by the customer.

9. Appointment Availability

All appointments are subject to availability.

The availability displayed through the booking system may change until the booking is successfully completed.

A consultation is considered confirmed only after:

1. the required booking information has been submitted;

2. the selected appointment has been successfully reserved; and

3. where applicable, the required payment has been successfully completed.

A booking confirmation may be sent by email, WhatsApp, SMS, calendar invitation or other available communication channels.

10. Consultation Duration

The duration of each consultation will be displayed during the booking process or otherwise communicated to the customer.

Customers are expected to join the consultation on time.

Where a customer joins late, the consultation may still end at the originally scheduled time so that subsequent appointments are not affected.

Destiny Decoded may, at its discretion, provide an alternative arrangement where circumstances reasonably permit.

11. Online Consultations and Zoom

Consultations may be conducted through Zoom or another online meeting platform selected by Destiny Decoded.

Customers are responsible for:

• having a compatible device;

• maintaining an adequate internet connection;

• providing a suitable environment for the consultation;

• joining using the correct meeting link; and

• ensuring that their device, microphone, speaker and camera function properly where required.

Meeting links may be provided through email, calendar invitations, booking confirmations, WhatsApp, or other communication channels.

Customers must not share private meeting links publicly or provide unauthorized persons access to a consultation.

12. Payment

Where a consultation is chargeable, payment must be completed using the payment method made available during booking.

Payments may be processed through third-party payment service providers, including Razorpay or other payment providers used by Destiny Decoded.

Destiny Decoded does not store complete card, banking or payment credentials unless expressly stated in the Privacy Policy and permitted by applicable law.

Payment processing may be subject to the terms, privacy policies and security practices of the relevant payment service provider.

A payment confirmation generated by a payment gateway does not by itself modify these Terms.

13. Pricing and Taxes

Prices displayed on the Website will be the applicable prices for the relevant service unless otherwise stated.

Where applicable, taxes, government levies or other legally required charges may be included in or added to the displayed price.

Destiny Decoded reserves the right to change prices for future bookings.

A price change will not ordinarily affect a booking that has already been successfully confirmed and paid for, unless required by law or due to an obvious pricing or technical error.

14. Refund, Cancellation and Rescheduling

Refunds, cancellations and rescheduling are governed by the Refund & Cancellation Policy published on the Website.

Unless otherwise expressly stated:

• customers may cancel or reschedule subject to the applicable cancellation window;

• cancellations made within the restricted cancellation period may not qualify for a refund;

• no-shows may be treated as non-refundable;

• rescheduling is subject to availability; and

• where Destiny Decoded is unable to provide a confirmed consultation, the customer may be offered rescheduling or an appropriate refund in accordance with the applicable policy and law.

Nothing in this section is intended to exclude rights that cannot lawfully be excluded under applicable consumer protection or other Indian law.

15. Customer Responsibilities

Customers agree to:

• provide accurate information;

• provide accurate birth details where required;

• provide accurate contact information;

• make payments using authorized payment methods;

• attend consultations at the scheduled time;

• behave respectfully toward the astrologer and staff;

• not harass, threaten, abuse or intimidate personnel;

• not impersonate another person;

• not use the Services for unlawful purposes;

• not attempt to interfere with the Website or booking system;

• not distribute confidential consultation material without authorization where such material is protected by law; and

• comply with all applicable laws.

16. Prohibited Conduct

You must not use the Website or Services to:

• commit or facilitate an offence;

• impersonate another person;

• provide false or fraudulent information;

• obtain Services through deception;

• harass, threaten, stalk or abuse another person;

• transmit malicious software;

• attempt unauthorized access to accounts, systems or databases;

• interfere with Website security;

• scrape or systematically copy Website content without authorization;

• reproduce or commercially exploit proprietary content without permission;

• upload unlawful, defamatory, obscene or infringing material;

• use the Services to threaten or exploit another person;

• encourage harmful or prohibited occult/black-magic practices;

• solicit or facilitate human sacrifice or physical harm;

• engage in fraudulent spiritual or supernatural claims intended to deceive or financially exploit another person; or

Destiny Decoded may suspend or terminate access to the Services where reasonably necessary to protect customers, employees, service providers, systems, or legal interests.

17. Accuracy of Website Information

However, information may occasionally contain typographical errors, technical errors, outdated information, omissions or inaccuracies.

Destiny Decoded reserves the right to correct errors and update information without prior notice.

Customers must not submit information belonging to another person unless they are legally authorized to do so.

• provide the requested consultation;

• administer bookings;

• communicate with the customer;

• process payments;

• provide customer support;

20. Privacy and Personal Data Protection

Destiny Decoded may use testimonials, reviews, photographs, videos, names, statements, recordings, or other customer content for publicity or marketing purposes only where the customer has provided the required separate and voluntary permission/consent.

• promotional videos;

• presentations;

• marketing campaigns; and

• other promotional materials.

A customer will not be deemed to have consented to promotional use merely because they booked or received a consultation.

Where publicity consent is obtained, the customer may request withdrawal of that consent for future use, subject to applicable law and the practical limitations applicable to material that has already been published or distributed.

Customers may voluntarily submit reviews, testimonials, ratings, photographs or other feedback.

Customers must ensure that any submitted content:

• is truthful;

• does not impersonate another person;

• does not contain unlawful or defamatory material;

• does not infringe another person's rights;

• does not disclose another person's personal information without authorization; and

• does not contain malicious software or harmful material.

Destiny Decoded may moderate or remove content that violates these requirements or applicable law.

No customer is required to provide a positive review in exchange for a benefit unless such arrangement is expressly permitted by applicable law.

30. No Misleading or Guaranteed Claims

Destiny Decoded will not intentionally represent an astrological interpretation as a guaranteed fact or guaranteed future outcome.

Customers should exercise caution regarding any third party who claims that Destiny Decoded or its representatives can guarantee:

• removal of all problems;

• protection from death or serious harm;

• supernatural powers;

• other communications reasonably necessary to provide the requested Service.

Marketing communications will be handled separately in accordance with applicable law and consent/opt-out requirements.

Customers are responsible for ensuring that the mobile number provided by them belongs to them or that they are authorized to provide it.

36. Confidentiality of Consultation Content

Customers should not record, reproduce, publish, livestream, distribute, commercially exploit, or publicly upload a private consultation without appropriate authorization, particularly where doing so would infringe the rights of Destiny Decoded, the astrologer, another customer, or another person.

Nothing in this section prevents a customer from exercising rights available to them under applicable law.

37. Professional Conduct During Consultations

Destiny Decoded expects consultations to be conducted respectfully.

Destiny Decoded may terminate a consultation without refund, where legally permissible and subject to the applicable Refund & Cancellation Policy, if a customer engages in serious misconduct including:

• threats;

• abusive or discriminatory conduct;

• harassment;

• sexual harassment;

• intimidation;

• violence;

• fraudulent conduct;

• unauthorized recording;

• attempts to obtain confidential information about another customer; or

• other unlawful conduct.

Nothing in this section limits any legal rights or remedies available to either party.

38. Limitation of Liability

To the maximum extent permitted by applicable law, Destiny Decoded shall not be liable for indirect, incidental, consequential, special or punitive losses arising from:

• reliance on astrological interpretations;

• decisions made by a customer;

• changes in personal circumstances;

• inaccurate information supplied by the customer;

• failure to attend an appointment;

• internet or telecommunications failures;

• third-party platform failures;

• payment gateway interruptions;

• Zoom or other meeting-platform failures;

• unauthorized access caused by circumstances outside reasonable control;

• or other circumstances beyond Destiny Decoded's reasonable control.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable Indian law.

Nothing in these Terms is intended to exclude statutory consumer rights or remedies available under applicable law.

39. Force Majeure

Destiny Decoded shall not be responsible for delay or failure to perform caused by circumstances beyond reasonable control, including:

• natural disasters;

• fire;

• flood;

• epidemic or pandemic;

• government action;

• war;

• civil disturbance;

• power failure;

• internet or telecommunications failure;

• cyber incidents;

• strikes;

Where reasonably possible, Destiny Decoded will attempt to reschedule affected consultations.

40. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless Destiny Decoded and its owners, representatives, personnel and service providers from claims, losses, liabilities, damages, costs and expenses arising from:

• your breach of these Terms;

• your unlawful use of the Website or Services;

• fraudulent or misleading information supplied by you;

• infringement of another person's rights;

• misuse of the Services;

• unauthorized disclosure of another person's information by you; or

• your violation of applicable law.

This clause does not require you to indemnify Destiny Decoded for losses caused by Destiny Decoded's own unlawful conduct or liability that cannot legally be transferred.

The Consumer Protection Act, 2019 and related rules provide the statutory framework for consumer protection in India, including consumer protection in e-commerce where applicable.

43. Consumer Protection

Nothing in these Terms is intended to:

• waive a consumer's statutory rights;

• exclude remedies available under applicable consumer-protection law;

• permit misleading representations;

• prevent a customer from making a lawful complaint; or

• restrict any remedy that cannot legally be restricted.

Where applicable, Destiny Decoded will comply with the Consumer Protection Act, 2019, applicable rules and regulations, and other consumer-protection requirements.

The Department of Consumer Affairs publishes the Consumer Protection (E-Commerce) Rules, 2020 and related consumer-protection materials.

44. Compliance With Indian Information Technology Laws

Destiny Decoded intends to operate its Website and digital Services in accordance with applicable Indian information-technology laws and regulations, including applicable provisions of the:

• Information Technology Act, 2000;

• applicable rules and regulations made under it;

• Digital Personal Data Protection Act, 2023, to the extent applicable and in force;

45. Compliance With Maharashtra Law

Where the Services are provided from or into Maharashtra, Destiny Decoded will comply with applicable Maharashtra laws.

In particular, Destiny Decoded does not authorize or promote activities prohibited under the Maharashtra Prevention and Eradication of Human Sacrifice and other Inhuman, Evil and Aghori Practices and Black Magic Act, 2013.

The Act's statutory savings expressly include advice by astrologers and Vastu practitioners, while the Act separately addresses prohibited inhuman, exploitative and black-magic practices.

Nothing in these Terms should be interpreted as authorizing any activity prohibited by that Act or any other applicable law.

46. Relationship Between the Customer and Destiny Decoded

Use of the Services does not create:

• an employment relationship;

• partnership;

• agency;

• joint venture;

• fiduciary relationship;

• medical relationship;

• lawyer-client relationship;

• financial-adviser relationship; or

• any other professional relationship beyond the specific consultation service purchased,

unless expressly established by a separate written agreement.

47. No Reliance on Website Content

Information published on the Website is intended for general informational and educational purposes.

Although reasonable efforts may be made to maintain accuracy, Destiny Decoded does not warrant that every article, prediction, interpretation, statement or other content will always be complete, current, error-free or suitable for every person.

Customers should independently evaluate information before acting upon it.

48. Changes to Services

Destiny Decoded may modify, discontinue, add or remove Services, features, content or booking options from time to time.

Changes will not ordinarily affect a consultation that has already been confirmed and paid for, except where necessary due to legal, safety, technical or operational reasons.

Where a confirmed paid consultation cannot be provided due to such a change, Destiny Decoded will seek to provide an appropriate alternative or refund in accordance with applicable law and the Refund & Cancellation Policy.

49. Changes to These Terms

Destiny Decoded may update these Terms from time to time.

The updated version will be published on the Website with a revised effective date.

Where a change materially affects existing customers, reasonable notice may be provided where appropriate.

Continued use of the Website after the effective date of updated Terms may constitute acceptance of the updated Terms to the extent permitted by applicable law.

50. Severability

These Terms, together with the Privacy Policy, Refund & Cancellation Policy and any applicable service-specific terms, constitute the principal agreement governing your use of the Website and Services.

Any additional written agreement applicable to a particular service will prevail over these Terms to the extent of an express conflict.

53. Assignment

You may not transfer or assign your rights or obligations under these Terms without prior written consent where such consent is required.

Destiny Decoded may transfer or assign its rights and obligations in connection with a business restructuring, merger, acquisition, sale of assets, or other lawful business transaction, subject to applicable law.

54. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable mandatory consumer-protection and other statutory jurisdictional provisions, courts having appropriate jurisdiction in Delhi, India shall have jurisdiction over disputes arising from these Terms or the Services.

Nothing in this clause prevents a consumer from exercising a statutory right to approach a consumer commission, court, regulator, or other authority having jurisdiction under applicable law.
